dc.description.abstractУ статті акцентується увага на необхідності переосмислення сутності явища, позначуваного терміном «система права». Проблематика системи права постійно перебуває в центрі уваги вітчизняних науковців, переважно через з’ясування співвідношення цього поняття з поняттям «правова система». Наголошується, що у вітчизняному правознавстві використовується ціла низка термів, які мають схожий зміст: право, система права, правова система, система законодавства. Саме право інтерпретується як система норм, тож ідеться про чотири системи. За умови сприйняття права як прескриптивного тексту усі вони є тотожними, оскільки і право є результатом діяльності органів публічної влади, що формалізується у тексті нормативно-правового акту. Стверджується, що термін «система права» використовувався у межах радянської юриспруденції, яка ґрунтувалася на постулатах нормативістської школи права. У основі радянської юриспруденції лежав принцип законності й саме закон сприймався як право. Права не існувало поза межами закону. Зазначається, що європейська фахова правнича література не використовує терміни «Legal System» і «System of Law» як відповідники понять «правова система» і «система права», усталеним є термін «Legal System», однак у значенні права, системи права.uk_UA
dc.description.abstractnoted by the term “system of law”. The issues of the system of law are constantly in the focus of national scholars, mainly because of clarifying the correlation of this concept with the concept of “legal system”. It is emphasized that a number of terms that have a similar meaning are used in domestic jurisprudence: law, system of law, legal system, and system of legislation. Herewith, law itself is interpreted as a system of rules. So the point is that there are four systems. Under the condition that law is perceived as a prescriptive text, they are all identical, since the law is the result of the activity of public authorities, which is formalized in the text of a legal act. It is argued that the term “system of law” was used within the limits of soviet jurisprudence, which was based on the principles of the normative school of law. At the heart of soviet jurisprudence was the principle of legality, and it was the law that was regarded as law. Law did not exist outside the law. It is noted that the European professional legal literature does not use the terms “Legal System” and “System of Law” as terms corresponding to the concepts of “legal system” and “system of law”; the term “Legal System” is fixed, but in the sense of law, the system of law.uk_UA
