dc.description.abstractСтаттю присвячено теоретичному аналізу концептуальних засад реформування системи місцевого самоврядування. Автор звертається до проблем становлення, розвитку та реформування місцевого самоврядування як багатогранного і комплексного політико-правового явища. Місцеве самоврядування розглядається як гарантоване державою право та реальна спроможність територіальної громади самостійно чи під відповідальність органів та посадових осіб місцевого самоврядування вирішувати питання місцевого значення в рамках Конституції та законів України. Проаналізовано загальновизнані засади місцевого самоврядування, що сформульовані у міжнародних правових документах – Всесвітній декларації місцевого самоврядування та Європейської хартії місцевого самоврядування. Наголошено, що місцеве самоврядування в Україні здійснюється територіальними громадами сіл, селищ, міст як безпосередньо, так і через сільські, селищні, міські ради та їх виконавчі органи, а також через районні та обласні ради, що становлять спільні інтереси територіальних громад сіл, селищ, міст. При цьому первинним суб’єктом місцевого самоврядування, основним носієм його функцій та повноважень є територіальна громада села, селища, міста. Розкрито зміст принципів місцевого самоврядування. Проаналізовано закони, що регулюють діяльність органів місцевого самоврядування та певні невідповідності системи його організації.
dc.description.abstractThe article is devoted to the theoretical analysis of the conceptual foundations of the reform of the local self-government system. The author addresses the problems of formation, development and reform of local self-government as a multifaceted and complex political and legal phenomenon. Local self-government is considered as a state-guaranteed right and the real ability of the territorial community independently or under the responsibility of local self-government bodies and officials to resolve issues of local importance within the framework of the Constitution and laws of Ukraine. The generally recognized principles of local self-government formulated in international legal documents – the Universal Declaration of Local Self-Government and the European Charter of Local Self-Government – have been analyzed. It was emphasized that local self-government in Ukraine is carried out by territorial communities of villages, towns, and cities both directly and through village, settlement, city councils and their executive bodies, as well as through district and regional councils, which constitute the common interests of territorial communities of villages, towns, bridge. At the same time, the primary subject of local selfgovernment, the main bearer of its functions and powers is the territorial community of a village, town, or city. The content of the principles of local self-government is revealed. The laws regulating the activities of local self-government bodies and certain inconsistencies in the system of its organization have been analyzed.
