dc.description.abstractУ статті висвітлено досвід впровадження різних форм позааудиторної роботи, зокрема гуртків з вивчення права, у закладах вищої військової освіти України у контексті гарантування академічної свободи. Проаналізовано категорію «академічні свободи». Представлено два виміри «академічних свобод»: сприяння інтелектуальному зростанню та помилкова «легкість». Репрезентовано, що академічні свободи – не лише права, а й обов’язки, визначені вказаними міжнародними документами й державними нормативно‐ правовими актами: підзвітність перед студентами, державою та суспільством, дотримання моральних норм, повага академічних свобод усіх учасників академічної корпорації тощо. З’ясовано, що вивчення права у проблемних гуртках створює умови для реалізації академічної свободи у вищих військових навчальних закладах при обмеженні інституційної автономії згідно законодавства. Результати дослідження вказують на те, що проблемні гуртки сприяють активному вивченню актуальних питань, обміну поглядами та розвитку творчого мислення, аналітичних і критичних навичок у здобувачів. Це дозволяє закладам вищої військової освіти забезпечувати для них академічну свободу навіть в умовах законодавчих та управлінських обмежень.
dc.description.abstractThe relevance of the investigated problem of non‐auditory forms of legal education in the higher military school of Ukraine as a manifestation of academic freedom is determined by the importance for the training of modern officers of understanding how the legal system works, and the influence of this system on his activities in the military sphere. The democratization of the educational process, the integration of military institutions of higher education into the national educational system ensure high‐quality training of specialists, and the leading principles of the institution’s functioning are autonomy and academic freedom. The stated principles are best embodied in creative, extracurricular work, taking into account the strict statutory regulation of cadets’ studies and leisure time. The features of legal education are highlighted: it is both a process and a result of acquiring systematized knowledge in the field of law and the formation of the necessary abilities and skills; has a purposeful and structured character; is mandatory and systematic, in accordance with the requirements of regulatory acts, and is conducted in various educational institutions; has a clear goal, which is to provide the individual with the necessary amount of legal knowledge and the formation of a high legal culture and consciousness aimed at the lawful behavior of a person. It has been proven that the realization of academic freedoms can most fully take place at the organizational and pedagogical level of higher military educational institutions, in particular, to be embodied in relatively free creativity and scientific research of participants in the educational process. Subject groups on the study of military and international humanitarian law as a form of legal education at the higher military school of Ukraine are represented. Socially (general education) and professionally (participation in conferences, Olympiads, scientific circles, student scientific society, research projects) are defined as categories of extracurricular work. It was revealed that the acquisition and deepening of legal knowledge by future officers in extracurricular time has its own advantages, such as the creative and research nature of this activity, voluntary participation, thorough study of problematic issues chosen by the acquirers at their own discretion, the creation of an informal communication environment that promotesthe free exchange of ideas between group members. It was found that the study of law in problem circles contributes to the realization of academic freedom in higher military educational institutions, as it gives students the opportunity to independently choose topics for study, research current issues and express their own views and opinions. Participation in problem circles allows cadets to freely realize their scientific interests, conduct research on a chosen topic, and also exchange knowledge and opinions with colleagues. This stimulates the development of creative thinking, analytical and critical skills, and also supports an active and open academic discussion among students of higher education
