Анотація
У статті досліджено теоретико-методичні та практичні засади цифрової трансформації регуляторних інструментів розвитку підприємництва в умовах становлення цифрової економіки та структурних змін у системі державного управління. Актуальність дослідження зумовлена необхідністю переосмислення традиційних підходів до регулювання підприємницької діяльності, які в умовах прискорення технологічного розвитку, поширення цифрових платформ, зростання ролі даних та посилення глобальної конкуренції потребують переходу від адміністративно-контрольної моделі до більш гнучкої, адаптивної та результато-орієнтованої системи регуляторного впливу. Особливої важливості ця проблема набуває для національної економіки України, яка перебуває в умовах цифрової модернізації, європейської інтеграції та необхідності формування ефективних механізмів підтримки підприємництва у процесі економічного відновлення. Метою дослідження є обґрунтування теоретичних положень та розроблення практичних рекомендацій щодо цифрової трансформації регуляторних інструментів розвитку підприємництва на основі концепції Smart Regulation, яка передбачає використання цифрових технологій, аналітичних систем, механізмів прогнозування та ризик-орієнтованого підходу для підвищення ефективності державного регулювання. Методологічною основою дослідження є сукупність загальнонаукових і спеціальних методів. Зокрема, використано метод системного аналізу – для дослідження взаємозв’язку між цифровізацією, державним регулюванням та розвитком підприємницького середовища; методи порівняльного аналізу та узагальнення – для вивчення сучасних підходів до Smart Regulation у зарубіжній і вітчизняній практиці; структурно-функціональний метод – для визначення елементів цифрової регуляторної системи; метод логічного моделювання – для формування авторського бачення механізму цифрової трансформації регуляторних інструментів. У процесі дослідження визначено сутність смарт-регулювання розвитку підприємництва як адаптивної цифрової системи державного впливу, що забезпечує узгодження інтересів держави, бізнесу та суспільства через використання цифрових платформ, електронних сервісів, відкритих даних, технологій Big Data, штучного інтелекту та інструментів автоматизованого аналізу регуляторної інформації. Обґрунтовано, що цифрова трансформація регуляторних інструментів не обмежується переведенням адміністративних процедур у електронний формат, а передбачає комплексну зміну принципів формування та реалізації державної політики у сфері розвитку підприємництва. Основними результатами дослідження є систематизація цифрових інструментів Smart Regulation та визначення їхнього впливу на підприємницьке середовище. Встановлено, що використання електронних адміністративних послуг, інтегрованих державних реєстрів, цифрових платформ взаємодії держави і бізнесу, RegTech- та SupTech-рішень сприяє скороченню адміністративного навантаження, підвищенню прозорості регуляторних процесів, зниженню витрат підприємців на виконання нормативних вимог та створенню сприятливих умов для інноваційного розвитку. Запропоновано концептуальну модель Smart Regulation розвитку підприємництва, яка включає інституційно-правовий, технологічний, аналітичний, сервісний та результативний компоненти. Наукова новизна дослідження полягає у поглибленні теоретико-методичних засад цифрової трансформації регуляторних інструментів шляхом обґрунтування авторської моделі смарт-регулювання розвитку підприємництва, що базується на інтеграції цифрових технологій, аналітичного забезпечення та механізмів адаптивного державного управління. Запропонована модель дозволяє перейти від традиційного реагування на порушення до проактивного управління регуляторними ризиками та забезпечення сталого розвитку підприємницького сектору. Практичне значення отриманих результатів полягає у можливості їх використання органами державної влади під час удосконалення регуляторної політики, розвитку цифрових сервісів для підприємців, формування механізмів підтримки малого та середнього бізнесу, а також адаптації національної системи державного управління до європейських стандартів цифрового врядування. Перспективи подальших досліджень пов’язані з розробленням комплексної системи оцінювання ефективності Smart Regulation, визначенням показників цифрової зрілості регуляторної політики, а також дослідженням можливостей використання штучного інтелекту, блокчейн-технологій і цифрових двійників у процесах державного регулювання підприємництва.
The article examines the theoretical and practical foundations of the digital transformation of regulatory instruments for entrepreneurship development in the context of the formation of the digital economy and structural changes in the public administration system. The relevance of the study is determined by the need to reconsider traditional approaches to regulating entrepreneurial activity, which, under conditions of accelerated technological development, the expansion of digital platforms, the growing role of data, and increasing global competition, require a transition from an administrative-control model to a more flexible, adaptive, and result-oriented system of regulatory influence. This issue is of particular importance for the national economy of Ukraine, which is undergoing processes of digital modernization, European integration, and the formation of effective mechanisms for supporting entrepreneurship during economic recovery. The purpose of the study is to substantiate theoretical provisions and develop practical recommendations for the digital transformation of regulatory instruments for entrepreneurship development based on the Smart Regulation concept, which involves the use of digital technologies, analytical systems, forecasting mechanisms, and risk-based approaches to improve the effectiveness of public regulation. The methodological framework of the research is based on a combination of general scientific and special methods. In particular, the study applies the systems analysis method to investigate the relationship between digitalization, public regulation, and the development of the entrepreneurial environment; comparative analysis and generalization methods to identify contemporary approaches to Smart Regulation in foreign and domestic practices; the structural-functional method to determine the elements of a digital regulatory system; and logical modelling to develop an authorial vision of the mechanism for transforming regulatory instruments through digital technologies. The study defines Smart Regulation of entrepreneurship development as an adaptive digital system of public influence that ensures coordination between the interests of the state, business, and society through the use of digital platforms, electronic services, open data, Big Data technologies, artificial intelligence, and automated regulatory information analysis tools. It is substantiated that the digital transformation of regulatory instruments is not limited to the conversion of administrative procedures into electronic form but represents a comprehensive transformation of the principles of public policy formation and implementation in the field of entrepreneurship development. The main results of the research include the systematization of digital instruments of Smart Regulation and the identification of their impact on the entrepreneurial environment. It has been established that the implementation of electronic administrative services, integrated state registers, digital platforms for state-business interaction, as well as RegTech and SupTech solutions contributes to reducing administrative burdens, increasing transparency of regulatory processes, decreasing compliance costs for entrepreneurs, and creating favourable conditions for innovative development. A conceptual model of Smart Regulation for entrepreneurship development has been proposed, which includes institutional-legal, technological, analytical, service-oriented, and outcome-based components. The scientific novelty of the research lies in the further development of theoretical and methodological foundations of digital transformation of regulatory instruments through the substantiation of an authorial model of Smart Regulation for entrepreneurship development based on the integration of digital technologies, analytical support, and adaptive public administration mechanisms. The proposed model enables a transition from traditional reactive control mechanisms to proactive management of regulatory risks and sustainable development of the entrepreneurial sector. The practical significance of the obtained results lies in the possibility of their application by public authorities in improving regulatory policy, developing digital services for entrepreneurs, forming mechanisms to support small and medium-sized enterprises, and adapting the national public administration system to European digital governance standards. Further research prospects are associated with the development of a comprehensive methodology for assessing the effectiveness of Smart Regulation, establishing indicators of digital maturity of regulatory policy, and studying the possibilities of applying artificial intelligence, blockchain technologies, and digital twins in public regulation of entrepreneurship.
