dc.description.abstractУ статті розглядається соціально-юридичний підхід до визначення категорії «делінквентна поведінка», що дозволить облегшити діагностику «делінквентної поведінки» з метою своєчасного застосування профілактичних заходів. Показано результати аналізу поглядів учених на зміст категорії «делінквентна поведінка», під якою розуміється поведінка, при якій неповнолітні здійснюють «протиправні вчинки», які мають зовнішні ознаки «правопорушень», але за які вони не можуть нести юридичну відповідальність у силу того, що в них не наступив стан юридичної «дієздатності». Визначено ознаки «делінквентної поведінки», що дозволяє відрізняти її від інших видів поведінки, що відхиляється. Здійснено обґрунтування видів «делінквентної поведінки».uk_UA
dc.description.abstractThe article investigated determination of the category «delinquent behavior». The results of analysis of the views of scientists on «delinquent behavior» are shown. Social and legal definitions of the category «delinquent behavior» are given. The signs of «delinquent behavior» are described, it allows to distinguish it from other types of behavior, that deviates. In social science category «crime» almost is not taken into account, and this category is being investigated only for reflection as: 1) a form of behavior; 2) a social phenomenon; 3) to indicate the program behavior. This has led to a certain heterogeneity in the interpretations of «delinquent behavior» and «delinquency». In criminology, to refer to acts, that violate legal norms established by law, «misconduct» or «crime2 are used. For the classification of the crime four obligatory signs must be present: 1) a public danger; 2) megal actions; 3) guilt; 4) punishability. In general, under the «delinquent behavior» we understand such behavior, which has outward signs of the «crime», but for which they bear no responsibility. Therefore, we have investigated that under «delinquent behavior» can be understood behavior that matches the description in the «Criminal Code of Ukraine» and «Administrative Code of Ukraine». In the «Criminal Code of Ukraine» it refers to: injuries, beatings, torture, threat, rape, invasion of privacy, stealing, robbery, murder, extortion, fraud, misappropriation of property of a stranger. In the «Code of Administrative Offences»: small robbery of the property, passing without a ticket, misconduct, dissemination of false rumors, smoking tobacco products in prohibited areas, the use of alcoholic beverages in places prohibited by law, or the appearance in public in a state of intoxication, risky games prostitution, violation of silence in settlements and public positions, untruthful calls etc.uk_UA
