Дослідження ґрунтується на аналізі вітчизняного законодавства, міжнародних нормативно-правових актів та сучасних наукових публікацій. Визначено зміст поняття інтелектуальної власності згідно з науковими дослідженнями. Окреслено основні особливості права інтелектуальної власності та його нормативно-правового регулювання. З’ясовано характеристики інтелектуальної власності як ресурсу стартапів, розглянуто сутність інтелектуальної власності як нематеріального активу, визначено основні стратегії управління інтелектуальною власністю у контексті діяльності стартапів. Проаналізовано практичні проблеми, що стримують розвиток українських стартапів.In the modern conditions of innovative development of the Ukrainian economy, intellectual property is a key resource for startups, as it determines their economic value and competitiveness. Therefore, in this study, it was important to clarify not only the nature of intellectual property as a resource for startups, but also to consider the main aspects and strategic approaches to intellectual property management in this context. The purpose of the article is to determine the role of intellectual property as a resource for startups; to analyze the features of intellectual property management as a resource for startups and strategic approaches to management in modern conditions. The study is based on the analysis of domestic legislation, international regulatory legal acts and modern scientific publications. The content of the concept of intellectual property is determined according to scientific research. The main features of intellectual property law and its regulatory and legal regulation are outlined, which is important for the regulation of intellectual property as a resource for startups. The characteristics of intellectual property as a resource for startups are clarified. The essence of intellectual property as an intangible asset, its role in the formation of innovative potential and attracting investments is considered. The main strategies for managing intellectual property in the context of startups are identified: early protection of innovations, commercialization, creation of an intellectual portfolio and international integration. The article examines the key practical obstacles that impede the sustainable development of Ukrainian startups, with particular emphasis on institutional, legal, and organizational deficiencies in the sphere of intellectual property protection and commercialization. Special attention is devoted to the role of intellectual property management systems as both a regulatory instrument and a driver of innovation-based growth.
