У статті досліджено підходи до інтерпретації категорії "інтелектуальна власність", деталізовано ознаки її ідентифікації. До класичних економічних ознак віднесено: функціональність, дворівнева структура, система прав і обов'язків, ринкова оцінка та лік- відність, правове регулювання, інноваційна активність та конкурентні переваги, механізми комерціалізації. Виділено ознаки інтелектуальної власності, зорієнтовані на виклики та можливості, спричинені стрімким розвитком цифрових технологій. Викладено авторське бачення категорії "інтелектуальна власність", яке підкреслює її місце і роль в цифровому економічному середовищі. Обґрунтовано, що для сталого розвитку економіки необхідно спри- яти міжнародній координації у сфері інтелектуальної власності, впроваджувати інноваційні технологічні рішення для захисту авторських прав.In the modern landscape of rapid technological progress and digital transformation, the field of intellectual property rights faces unprecedented challenges and opportunities. The article analyzes the transformation processes of intellectual property in the digital economy and the development of artificial intelligence. It is substantiated that intellectual property is a fundamental component of the world economy, plays a key role in the processes of innovative development, competitiveness of enterprises, and globalization of markets. The approaches to interpreting the category of "intellectual property" that were considered by domestic scientists in the field of economics and management are studied. The features of identification of intellectual property are highlighted, which make it possible to reveal its essence as an economic category. The classical features include: functionality, two-level structure, system of rights and obligations, market valuation and liquidity, legal regulation, innovative activity and competitive advantages, commercialization mechanisms. The specific features of intellectual property, focused on the challenges and opportunities caused by the rapid development of digital technologies, are detailed and substantiated. The impact of artificial intelligence on the formation of intangible assets, issues of copyright and legal liability in the creation of intellectual property objects are analyzed. The problem of digital piracy and uncontrolled distribution of intellectual assets is considered. Effective mechanisms for protecting intellectual property are highlighted, including smart contracts, digital watermarks, artificial intelligence algorithms for monitoring violations. The role of global digital platforms in the distribution, commercialization and regulation of intellectual property, the need to harmonize international legislation to ensure effective legal protection are outlined. Based on the results of the study, the author's vision of the category "intellectual property" is presented, which emphasizes its place and role in the digital economy.
