Людські права в сфері охорони здоров`я (за матеріалами практики Європейського суду з прав людини)

Abstract

У статті акцентується увага на тому, що розглядаючи справи, пов’язані з порушенням національними органами публічної влади прав людей у сфері надання медичної допомоги та медичних послуг, Європейський суд з прав людини з’ясовує наявність чи відсутність порушень ст. 2 (право на життя) і ст. 3 (свобода від катувань) Конвенції про захист прав людини та основоположних свобод.

The article focuses on examining cases involving a breach of the rights in the field of health care and medical services provision by the public authorities, the European Court of Human Rights finds out whether or not there has been a violation of Art. 2 (the right to life) and Art. 3 (freedom from torture) of the Convention for the Protection of Human Rights and Fundamental Freedoms. However, if the victim was killed, the Court first determines the existence or absence of violations of Art. 2, if the victim is alive - the presence or absence of violations of Art. 3.
