Правосвідомість v. відчуття справедливості

Abstract

У статті акцентується увага на відмінностях термінології у межах різних розумінь права. Аналізується відповідність розуміння правосвідомості вітчизняною юридичною наукою сучасним реаліям. Зазначається, що право не обмежується лише прескритивним текстом, а тому не повинно ототожнюватися із законом і, відповідно, знання законодавства, його оцінка не може пов’язуватися з правосвідомістю. Більш вдалим є використовуване західною правовою традицією поняття «sence of justice».

The article focuses on the differences in terminology within various conceptions of law. It is noted that the terms “legal consciousness”, “legal education” are not characteristic of the Western legal tradition (culture), as well as the term “legal culture” in the sense that it is used by the domestic legal science. These terms were actively used by the soviet legal science. The correspondence of the understanding of the legal consciousness to the modern realities by the domestic legal science is analyzed. It is emphasized that the term “legal consciousness” was used in the papers of such thinkers as P. Novgorodtsev and I. Ilyin, but in their interpretation the meaning of this term is closer to the “sence of justice” of the Western legal culture, but not to the legal consciousness in its domestic interpretation. The understanding of the legal consciousness by the soviet lawyers is based on the interpretation of the three-element structure of the psyche, which necessitates the separation of a whole range of consciousness (economic, cultural, religious, etc.), which violates the integrity of perception of a personality.
